- Tenant agrees not to reduce any month’s rental payment by either deducting therefrom or crediting thereto any amount of the security deposit. Tenant further agrees that such a deduction shall constitute a “willful” failure to pay rent as provided in Section 562A.27 (2) & (3), Code of Iowa, 1979.
- When surrendering or abandoning premises, tenant agrees to disconnect any garden hoses to prevent freezing, return all keys to property manager, wash any dirty walls, clean all kitchen appliances (stove, oven, refrigerator, and dishwasher), clean out all cabinets, clean all bathrooms, clean all floors, make sure all light fixtures have working light bulbs, repair broken window blinds, remove all items from premises, latch and lock all doors, latch all windows.
- Tenant agrees to pay a $50.00 fee for each dishonored check(s) not negotiated upon presentation. Also, rents not paid by the 4th day of the rental month shall carry a $40 delinquent charge and $2.00 per day thereafter up to a maximum of $60 per month for rents under $700 and up to $100 per month for rents over $700. The delinquent charge plus interest shall be calculated from the first day of the month of delinquency.
- It is hereby agreed and understood by all parties concerned that any notice of vacating at the end of lease terms will be given in writing 30 days in advance on or before the 1st of any month, and rents are due for the entire month of said notice.
- If Tenant fails to complete the full term of the lease, Tenant agrees to pay the rent, utilities, and perform the items as mentioned above in Note (B), until the property is rented or the lease term expires, whichever comes first.
- All appliances (stove, refrigerator, dishwasher and disposal) are the property of Landlord.
- Tenant agrees to place all garbage in a garbage bag and to place all trash inside the appropriate dumpster.
- Tenant agrees to replace the furnace filter every two (2) months. Tenant agrees to pay for any service call and/or cost of repair required as a result of the furnace filter not being replaced every two (2) months.
- Tenant agrees to have received keys (Do Not Duplicate). Tenant agrees not to have keys duplicated. Tenant agrees to pay $50.00 per key for any additional keys required for the property. Tenant agrees to be responsible for all costs for the locks to be changed, if any keys are lost or stolen. Tenant agrees not to change the locks without the Landlord’s knowledge and written approval. Tenant agrees to return all keys to our office, when surrendering the property. Tenant agrees to be responsible for the cost of the locks to be changed if all keys are not returned to our office, on the move-out date.
- Tenant agrees to pay the landlord for lockout service. Locked out fees and procedures are as follows:
- Person must show identification.
- Person requesting access must be on the lease.
- The fees and hours are as follows:
Monday thru Friday 8AM to 5PM – $100.00
Monday thru Friday 5PM to 11PM – $50.00
After 11PM, Saturday, Sunday or Holidays – $150.0
11. Tenant agrees to carry a Renter’s insurance policy throughout the term of the lease. Tenant agrees to be responsible for the cost of the Renter’s insurance. Tenant agrees to provide the Landlord with proof of Renter’s Insurance upon move-in, upon request, and upon renewal of the Rental Agreement.
- Tenant agrees to be responsible for the repair cost for the appliances, plumbing and garbage disposal resulting from their misuse by tenant or tenant’s guests. Cost of the repairs will be charged to the tenant.
- In the event the property needs a professional insect extermination for items such as bed bugs or other “bugs” that a reasonable person would believe were brought into the property by the tenant, the tenant agrees to pay for the expense. If the tenant does not immediately make payment for the extermination, the expense will be taken from the deposit and the tenant will replenish the deposit balance prior to the lease termination or renewal.
- Above ground pools, hot tubs and trampolines are not permitted on the property.
- No parking is permitted on the lawn. The tenant agrees to pay for any repairs required to the lawn as a result of parking on the lawn.
- Tenant and all occupants shall conduct themselves in a manner that will not disturb a neighbor or other occupants’ peaceful enjoyment of the property or neighborhood. This includes but is not limited to crime free behavior of all occupants and visitors and no loud noises either by voice, music or harassment. Additionally, Tenant agrees to keep personal and public areas clean and odor free.
- No smoking in the building or within 10 feet of any entrance.
- Tenant agrees to keep the heat on and not to set the thermostat below 62 degrees during the winter months of October, November, December, January, February, March and April.
- Tenant agrees to allow the property to be inspected at least quarterly by landlord throughout the duration of the lease. Landlord will provide written or verbal notice prior to the inspection.
- Tenant agrees that all personal belongings must be removed from the unit when tenancy is terminated or if the unit has been abandoned. The tenant agrees that any property remaining after termination or abandonment becomes the property of the landlord and the tenant has forfeited possession rights. The tenant understands that they may be charged for the removal of any items left in the unit after termination or abandonment.
- Violations of this and the dwelling rental agreement provisions will be cause for termination of this lease by the landlord with 3 days notice.
- No pets without prior approval from landlord and payment of applicable fee.
- Notices to and from the tenant and manager may be sent by electronic messages.. Both parties will acknowledge receipt of notices when sent.
